Safe Harbor which may be initiated by a LVN, RN or APRN prior to accepting an assignment or engaging
in requested conduct that the nurse believes would place patients at risk of harm, thus potentially
causing the nurse to violate his/her duty to the patient(s). Invoking safe harbor in accordance with Rule
217.20 protects the nurse from licensure action by the BON as well as from retaliatory action by the
employer. (Texas BON)
Objectives:

The student will be able to discuss role of peer review in creating and sustaining quality and
safety outcomes
The student will explain evidence-based practice principles for nursing peer-review activities in a
contemporary model of nursing practice
The student will to describe the purpose and protection for the nurse when invoking “Safe
Harbor Peer Review.”

A. YOU MUST FOLLOW FOR 8 HOURS A CLINICAL MENTOR (I.E. CNO, Ethics and Compliance
Coordinator, Risk Manager, QI Coordinator, Unit Director, etc.)

With your own employment or hospital setting, please identify a recent case scenario on peer
review/safe harbor. You will be required to do background research on state laws, review institutional
policies at your place of employment or selected clinical site. Additionally, you will be required to
interview a relevant stakeholder regarding the process in addressing this peer review/safe harbor
scenario.
1. Discuss scenario which precipitated the need for peer review and/or safe harbor. Please do not
use any patient or employee identifiers (i.e. nurse a or b; patient a or b, etc.)
2. Identify ethical conflicts in patient or employee situations
3. Which Code of Ethics was violated if applicable in your selected scenario?
4. Which ethical theory is evident in your selected scenario?
5. Describe the process in addressing the ethical issue as it relates to peer review and/or safe
harbor
6. How does the role of the ethics committee differ from peer reviews and/or safe harbor
situations?
7. Interview a relevant stakeholder well versed in dealing with ethics, peer and safe harbor review?
(i.e. CNO, Ethics and Compliance Coordinator, Risk Manager, QI Coordinator, Unit Director, etc.)

8. What is the role of the stakeholder? Advisor? Facilitator? Decision Maker?
9. How does she/he facilitate recommendations by the committee?
