APPELLATE OPINION RESEARCH PROJECT ASSIGNMENT – 7 to 9 pages (double spaced) with Reference List:
Assignment:
* Locate and analyze an appellate court case opinion (state or federal) directly related to the course objectives. If you check with the professor first, you may also use a Court of Federal Claims opinion.
* Explain briefly (like one sentence) why you chose this specific case, and discuss (again briefly) how the opinion relates to one or more of the course objectives.
* Briefly identify the parties to the dispute and explain the facts of the dispute.
* Identify and analyze the issues raised by the opinions. If appropriate, include a discussion of the historical context of the case, and practical implications for procurement professionals or policymakers.
* Locate and discuss any expert commentary that you have been able to find (e.g., law review articles) regarding the opinion and any prior or subsequent opinions or articles that relate to the opinion in question.
* Discuss any public policy issues raised by the opinion.
* State your agreement or disagreement with the outcome of the opinion and defend your conclusion.
* Key issues raised by the opinion should be analyzed in depth, with detailed attention to historical context and practical implications for practitioners or implications for legislative or executive policymakers. Expert commentary and public policy issues may or may not be raised by the case.
Note:
* You must cite your chosen case and any other cases in the proper legal citation format as we studied early in the course.
* References supporting the description or analysis must be specifically and correctly cited in accordance with APA standards. Multiple references should be used where appropriate.
* References should be specific down to a level of section or page numbers of the source, and not a URL. The accuracy and precision of citations will be graded. (No URLs unless that meets APA standards for a particular reference.)
* Your work product should demonstrate effective written communication and graduate level writing, and should comply with the basic formatting and citation requirements of the Publication Manual of the American Psychological Association, 7th Edition. Information on these guidelines can be found on the Purdue Online Writing Lab . A table of contents is optional and will not count against your page total.
* There is an additional document called Case Analysis Framework with some additional suggestions, not requirements, just suggestions. Do not use it as an outline for the paper.
* Your writing skills effect all parts of the rubric because the clarity of what you say makes your message come through in the grading.
* If you have questions, please ask.
Grading Rubric: There is a separate grading rubric showing the four areas of grading. It is posted with these instructions.
The court case listed below is what I chose.
